ONLINE ORDERS

Payment in whole, by credit card or debit card, is required before dispatch of goods. Once payment has been received by Alpacappella Jewellery, I will confirm that your order has been accepted by sending a confirmation email to you at the email address you provide in your online order form.
Goods supplied by Alpacappella Jewellery to customers remain the property of the Company until paid for in full by the customer.

GIFT CARDS

Gift cards can be redeemed for Alpacappella Jewellery purchases directly from www.alpacappella.com using the unique card code number. It cannot be used in 3rd party outlets. The card is valid for 12 months from date of purchase, so you have plenty of time to choose something beautiful. You can use the card in part payment for Products of a higher value. Cards cannot be returned or refunded, except in accordance with your legal rights. Unused balance cannot be converted back into cash.

RETURNS

Alpacappella Jewellery is happy to accept returns of unwanted items. All items must be returned within 14 days of delivery unworn in their original packaging with proof of purchase. I am unable to accept returns of items purchased through a retailer or internet third party. A refund will be made to the card used when placing your original order and will be for the full amount of the product purchased. It is important that you return the products promptly so that I can carry out the refund within 14 days of receipt.

Unfortunately, because of the nature of these items, unless they arrive damaged or defective, AJ can’t accept returns for custom or personalised orders.

Please note, that you will be responsible for the delivery charges and costs of returning the items to AJ unless I delivered the item to you in error, or if the item in question is damaged or defective. If I do not receive the item back from you, I may arrange for collection of the item from your residence at your cost.

Unfortunately, because of the nature of these items, unless they arrive damaged or defective, AJ can’t accept returns for custom or personalised orders.

I recommend that you use a recorded delivery service (eg. Royal Mail Recorded or Special Delivery) for your own protection. In the event of failure to return any item to AJ within the time limits stated, even though validly cancelled, I reserve the right to charge any costs of recovery of the goods.

I cannot accept responsibility for any items lost or stolen in transit if they am not sent back via Royal Mail Recorded or Special Delivery. Please note that unidentified returns will be returned to the sender and will not be refunded. Any item returned after the given time period will only be refunded at Alpacappella Jewellery discretion.

RETURNS FROM OVERSEAS

The same returns process as for the UK applies except:

You will be responsible for arranging to have the item(s) returned to AJ, and for any costs incurred. I would strongly recommend that you use FedEx/ DHL to return your items to AJ, as I am not responsible for any items which do not reach AJ. Please ensure that you write clearly on the FedEx/DHL paperwork that the item is being returned, and send to:

You are responsible for any carriage costs incurred in returning your jewellery. Please put the item in the original packaging and seal it securely. Once I have received the returned item, I will confirm receipt of the parcel by email.

RETURNING FAULTY GOODS:

In the rare and unlikely event that you receive a damaged or faulty item, please follow the standard Returns Policy as detailed above.

Faulty items will only be accepted if the goods am delivered to the customer damaged. All items returned as faulty will be inspected, and any item displaying damage deemed to be a result of fair wear and tear will not be accepted as faulty. Postage / shipping costs will be refunded on any faulty goods.

Where possible, items may be repaired on request but only where such items am deemed faulty and repairable. Repairs do not come with a guarantee.

Please note, it may be possible for AJ to repair items which have suffered wear and tear. There will be a charge for this service, which is to cover the cost of shipping and any other repair costs incurred. If in the rare occasion your item is faulty, you can request a returns postage slip by emailing marta@alpacappella.com.

REFUNDS

Refunds will be made within 14 working days of receipt of the returned goods. All undamaged, correctly returned products will be credited to the original purchaser’s credit card. Refunds do not include postage / shipping costs.

PRICES AND PAYMENT

All prices and charges on the website are shown in UK pounds sterling, include VAT and are subject to change. They do not include any delivery charges. These will be shown separately (where applicable) during the order process.

Prices may change at any time, but changes will not affect orders in respect of which I have already sent you an order confirmation.

The website contains a large number of products and it is possible that, despite my attention to detail, some of the products listed on the website may be incorrectly priced. I am under no obligation to provide the product to you at the incorrect (lower) price, even after I have sent you an order confirmation, if the pricing error is obvious and could have reasonably been recognised by you as a pricing mistake.

REGISTRATION AND DATA PROTECTION

Any personal Information you provide when you register as a customer on the website must be true and accurate. You agree not to impersonate any other person or to use a false name. If you wish to purchase products on the website you must provide AJ with the information required and specified by AJ. Further, by placing an order you agree and understand that I may store and process your personal data. I fully respect the privacy of customers who access and use my website. INTELLECTUAL PROPERTY

Alpacappella Jewellery goes to great lengths to innovative new designs and manufacture of its products in its own workshops to prevent it being copied. It therefore takes intellectual property very seriously. This includes the design and content of my website.

The Alpacappella Jewellery trade mark as well as all trade marks, whether they am figurative or not, and all other marks, trade names, service marks, brand names, business names, illustrations, images and photographs, logos, registered or unregistered designs, copyrights and patents (“Intellectual Property”), which constitute and/or appear on our products, product description, website, accessories or packaging, whether registered or not, are and remain the exclusive property of Alpacappella Jewellery. Any reproduction, whether complete or partial, modification or use of the Intellectual Property, for whatever reason and in whatever medium, without our written, express and prior agreement is strictly prohibited.

The entire content of the website, including all jewellery design, copyright, trademarks and other intellectual property rights it contains, including the use of the name Alpacappella Jewellery is the sole property of Alpacappella Jewellery and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this website nor may you use any such content in connection with any business or commercial enterprise unless given express permission.

QUALITY

All goods sold by Alpacappella Jewellery meet statutory requirements. However, Alpacappella Jewellery cannot accept responsibility where goods supplied are subject to further processing or repackaging by the customer.

Please note that all items am hand-crafted from natural materials and as such their composition and colour may vary slightly from the image shown. There may also be minor variations in actual dimensions and specifications.

PHOTOGRAPHY

Some items may appear slightly larger or smaller than actual size due to screen defaults and photography techniques. Other items may be represented at a larger than actual size in order to clearly show details or smaller than actual size in order to show the entire item. Every effort has been made to illustrate colours accurately but this is not always possible with digital reproduction on different web browsing platforms. Hence, there can be no guarantee that the true colour of the jewellery will be exactly as shown.

Alpacappella Jewellery assumes no liability whatsoever for the topicality, correctness, completeness or quality of the information provided. All content is subject to change without notice. Alpacappella Jewellery expressly reserves the right to modify, supplement or delete parts or the entire content of this site, without prior advance notice, or to suspend or terminate the site.

ONLINE PAYMENT

All payments on www.alpacappella.com are processed via Take Payments or PayPal. Alpacappella Jewellery assumes no liability whatsoever for the availability and functionality or any financial loss caused by the use of these services.

CANCELLATION POLICY

CANCELLATION BY YOU:

If you would like to cancel your order, please contact AJ before you receive your ‘Dispatch email’ at marta@alpacappella.com.
Please note, that once your item has been despatched I am unable to recall it and will no longer be able cancel it; in this case please see my Returns Policy.

CANCELLATION BY AJ:

I reserve the right to cancel the contract between you and AJ if: I have insufficient stock to deliver the goods you have ordered, or one or more of the items you ordered was listed at an incorrect price due to a typographical error.

If I do cancel your contract I will notify you by e-mail and will re-credit to your account any sum deducted by AJ from your credit card as soon as possible, but in any event within 5 working days of your order. I will not be obliged to offer any additional compensation for disappointment suffered.

COMPLAINTS

If you find that you am not satisfied with any product or service please contact me at marta@alpacappella.com. You will receive a written response within 7 working days. I will endeavour to resolve any complaint within a further 14 working days.

MISTAKES IN INVOICES, RECEIPTS OR PAYMENTS

Any mistakes in invoices, receipts or payments will be rectified as soon as possible, and at the latest within 5 working days of agreeing to do so.

CLAIMS

Claims can only be made by e-mail: marta@alpacappella.com. Any claims made before prior communication with the Alpacappella Jewellery will not be considered.

All goods must be counted and checked at the time of delivery. Any damage or faults must be reported on receipt of the goods. This does not affect your statutory rights as a consumer.

Any claim in respect of the above should be made by e-mailing to marta@alpacappella.com within 48hrs of delivery.
No claims will be entertained unless the above conditions are strictly adhered to.
No credit or refund will be given for any goods ordered in error by the customer.
No credit or refund will be given for any losses due to the incorrect storage or handling by the customer of any goods supplied by Alpacappella Jewellery.

AGREEMENT

LIABILITY

If you do not receive goods ordered by you within 7 working days of the date on which you ordered them, I shall have no liability to you unless you notify AJ by e-mail of the problem within 14 days of the date on which you ordered the goods.

If the goods I deliver are not what you ordered, or are damaged or defective, or the delivery is of an incorrect quantity, I shall have no liability to you unless you notify AJ by e-mail of the problem within 7 working days of the delivery of the goods in question.

If you notify AJ of a problem under this condition, my obligation to you will be either:
To make good any shortage or non-delivery; or
To replace any goods that am damaged or defective; or
To refund to you the amount paid for the goods in question in whatever way I choose.

Save as precluded by law, I will not be liable to you for any indirect or consequential loss, damage or expenses howsoever arising out of any problem you notify AJ of under this condition and I shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question as stated above.

I cannot be held responsible for any delays once the goods have left AJ and are in possession of the courier or Royal Mail.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from my site. The importation or exportation of certain of my goods to you may be prohibited by certain national laws. I make no representation and accept no liability in respect of the export or import of the goods you purchase.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any personal injury resulting from our negligence.

INVALIDITY

If any part of these terms and conditions is unenforceable (including any provision in which I exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

GOVERNING LAW

Each and every transaction carried out is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with English Law and the English Courts shall have exclusive jurisdiction in relation thereto.

ENTIRE AGREEMENT

These terms and conditions, together with my current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by AJ. Nothing said by any sales person on my behalf should be understood as a variation of these terms and conditions, or as an authorised representation about the nature or quality of any goods offered for sale by AJ.

I make no representations or warranties about the accuracy, completeness or suitability for any purpose of the information and related graphics published on our website. From time to time my  site may contain technical inaccuracies or typographical errors.

EVENTS BEYOND MY CONTROL

I will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delay or failure is due to circumstances beyond its reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, pandemic, explosion or accident.

OUR RIGHTS

I reserve the right to change the terms and conditions from time to time, and your continued use of the website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the website.

DISCLAIMER

Alpacappella Jewellery work to keep the site up to date but cannot guarantee that this site and its contents are completely free of technical errors, incorrect prices or information. By using this site, you acknowledge that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with this site. I am also not liable for any damages associated with use of this site however caused. If you are not satisfied with the site, then please email AJ with your comments. However, your only legal recourse is to stop using the site.
